Terms of Service

These Terms of Service govern your use of sworharts.com and set out the general basis on which Sworharts Interiors LLC provides interior design services. Individual projects are also governed by a signed proposal, which takes precedence if the two conflict.

2. Using this website

You may view, download and print pages of this website for your own use. You may not republish our text or photographs commercially, misrepresent your relationship with the studio, or attempt to interfere with the site's operation or security.

3. Content and pricing accuracy

Fees shown on this site are starting figures for design work as of the last update. They are not offers. Furniture, materials and trade labour are quoted separately. Every project is confirmed by a written proposal with a fixed fee, scope and schedule before work begins.

4. Enquiries

Sending an enquiry does not create a contract. A contract exists only once you have accepted a written proposal and paid the first instalment.

5. Payment

Design fees are invoiced 50/50 for consultations and single rooms, and in three stages for larger projects. Payment is accepted by card, ACH bank transfer or check and is due within 14 days of invoice. Purchases made on your behalf are paid at cost with no markup and are invoiced separately.

6. Cancellation and refunds

You may cancel a booked consultation up to 48 hours in advance for a full refund; inside 48 hours we retain 50% to cover the reserved time. For design projects, you may end the engagement in writing at any time; you pay for work delivered up to that date and any non-cancellable orders already placed on your behalf. Goods ordered from suppliers are subject to that supplier's own returns terms, which we will always send you before ordering.

7. Intellectual property

Drawings, schedules and concept material remain our intellectual property until the final invoice is paid, at which point you receive an unlimited licence to use them for the property they were prepared for. We retain the right to photograph completed work for our portfolio unless you ask us in writing not to.

8. Third parties

Where you contract builders, trades or suppliers directly, your agreement is with them. We coordinate their work but are not responsible for their workmanship, delivery times or warranties.

9. Liability

Nothing in these terms excludes liability for death, personal injury or fraud caused by our negligence. Subject to that, our total liability arising from any project is limited to the design fees you have paid us for that project. We are not liable for indirect or consequential losses.

10. Governing law

These terms are governed by the laws of the State of Montana, USA. Disputes are subject to the exclusive jurisdiction of the courts of Lewis & Clark County, Montana. We will always try to resolve a problem by conversation first.

11. Changes

We may update these terms; the version published on the date of your proposal is the one that applies to your project.
